These Terms of Service ("Terms") govern your access to and use of tinyhomes-us.com (the "Site") and the products and services offered by tinyhomes-us ("we," "us," or "our"). By browsing the Site, submitting a quote request, creating an account, or placing an order, you agree to these Terms.

1. Acceptance of Terms

By using the Site, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the authority to enter into a purchase agreement on behalf of yourself or the entity you represent. If you do not agree with these Terms, please do not use the Site.

2. Accounts

Some features, including checkout and order history, require a customer account. You agree to provide accurate information when registering, to keep your password confidential, and to notify us promptly at info@tinyhomes-us.com if you suspect unauthorized use of your account. You're responsible for all activity that occurs under your account.

3. Products, Pricing and Availability

We make a reasonable effort to keep product descriptions, specifications, photos, and pricing accurate and up to date. However:

• Prices, quantity available, and lead times are subject to change without notice, and the price and availability shown at the time you complete checkout will apply to your order;
• Placeholder illustrations are used for products until real photography has been uploaded, and finished homes may vary slightly in appearance, materials, and finish from any photo or illustration shown;
• We reserve the right to limit quantities, refuse an order, or correct pricing or listing errors, even after an order has been submitted, and will contact you if this affects your order.

4. Quotes and Orders

Submitting the "Get a Quote" form is a request for information only and does not create a contract or reserve a product. Placing an order through checkout is an offer to purchase, which we may accept or decline. For a ready-built, in-stock home, we will typically follow up directly to confirm delivery details and any site-specific requirements. For a home built from scratch to your specification, we will typically follow up directly to confirm specifications, timeline, and any site- or zoning-specific requirements before production begins. Given the nature of our homes, cancellation, change, and refund terms for a confirmed order will be set out in the written order confirmation we send you, and take precedence over any general statement on the Site.

5. Delivery

Estimated build and delivery timelines shown on the Site or given during a consultation are estimates, not guarantees, and can be affected by factors like site access, permitting, weather, and material availability. Please see our Shipping and Returns page for more detail on delivery.

6. Acceptable Use

When using the Site, you agree not to:

• Submit false or misleading information through any form, including the quote request or checkout forms;
• Attempt to gain unauthorized access to any account, the admin dashboard, or our systems;
• Use the Site to transmit spam, malware, or unlawful content;
• Scrape, reverse-engineer, or interfere with the normal operation of the Site;
• Use the Site for any purpose that is unlawful or prohibited by these Terms.

7. Intellectual Property

All text, graphics, logos, product designs, and other content on the Site are owned by tinyhomes-us or our licensors and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission, except for your own personal, non-commercial use (such as saving a photo to reference during your build).

8. Warranty Disclaimer

Except for any written warranty provided with a specific home purchase, the Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, tinyhomes-us will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we've been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed the amount you paid to us for the order giving rise to the claim, or $100 if no order is involved. Some jurisdictions don't allow these limitations, so some of them may not apply to you.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Buncombe County, North Carolina.

11. Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted to this page, and we'll update the "Last updated" date above. Continuing to use the Site after changes are posted means you accept the revised Terms.
